Why do we need a new Animal, Environment, Nuisance and Pest Local Law?
The Local Law has been drafted in response to changes in State Legislation. The new Public Health Act 2016 (Act), which received royal ascent in 2016, will replace the existing Health (Miscellaneous Provisions) Act 1911 (Health Act). As part of the transition to the new Act, the Health Act will be repealed, including the provision that enables local governments to make Health Local Laws.
This new Local Law sitting under the Local Government Act will ensure the Town has laws in place to respond to issues relating to Animals, Nuisance and Pests.
Was a review of the Local Law completed?
Yes, a review of the existing provisions dealing with animals, nuisances and pests was undertaken to ensure they were contemporary.
What changes are being made to the laws regarding the keeping of poultry?
The number of poultry or other caged birds permitted to be kept without the written approval of the local government is to be reduced from 20 to 12. The current limit of 20 birds originates at least as far back as the Model By-Law Series A of 1963. Reducing the number to 12 will bring the Town into line with other similar local governments, and is considered to be better suited to today’s smaller lot sizes.
The provision relating to the setback of poultry enclosures to a dwelling of 9 metres to any dwelling will be amended to 9 metres from a neighbouring dwelling and 5 metres to the opening of the dwelling of the person keeping the poultry. The intent of this change is to allow for greater opportunity for residents to keep poultry on smaller lots whilst maintaining the amenity of their neighbours, i.e. odour, flies, noise and vermin which are commonly associated with the keeping of poultry.

- Recycling (clean plastic, aluminium, steel, glass, paper and cardboard items with all lids removed) – Only Recyclable Materials
- FOGO (Food Organic Garden Organic) including all vegetable/fruit/meat scraps from the kitchen, soiled paper towels and tissues and soiled pizza boxes) – Only Organic, derived from living matter
- General Waste (non-hazardous wastes, and those wastes that cannot be recycled and have not been derived from living matter)
Why do we need new Waste Local Law?
The Waste Local Law 2019 will improve the Town’s management and enforcement of waste related activities and support the targets set out on the State Governments recently adopted Waste Avoidance and Resource Recovery Strategy.
What is the Waste Avoidance and Resource Recovery (WARR) Strategy 2030?

The Strategy and associated Action Plan provide clear targets and actions for Community, Industry and Government to reduce waste and increase material recovery.
One of the targets for the strategy is the implementation of a Better Bin or 3-bin system for all local governments in the Perth and Peel Regions. This is being partly funded through the State Government’s Better Bins Program.
What is the Better Bins Program?
The Better Bins or 3-Bin program supports our community to separate waste at the source, increases recycling capacity, reduces waste to landfill and provides stronger environmental outcomes.
Waste from household and commercial properties will be separated into three waste streams: Recycling, FOGO (Food Organics Garden Organics) and General Waste
Only those materials that cannot be recycled or turned into compost, will be placed into the “General Waste” bin for transport to landfill.
Why do I need a FOGO Bin?
The Town of Bassendean is working towards introducing a Food Organics and Garden Organics (FOGO) bin service in 2019 for all Town of Bassendean residents/ ratepayers.
Research shows that the “current” general waste bin contains approximately 60% organic material, so by the Town providing you a dedicated FOGO bin, you will be able to place all of this Food Organics and Garden Organics derived from living matter into a dedicated bin for processing into high value compost. This compost can then be used by the horticulture/ agriculture industry and others to improve soil conditions.
The Waste Authority has mandated that by 2025 all local governments in the Perth and Peel region will be required to provide consistent three bin kerbside collection systems that include separation of FOGO from other waste categories.
Reducing the amount of waste that goes to landfill will reduce the costs, enhance the environment and create significant opportunities for economic growth and job prospects.
What can I do to help make this new bin system a success?
It is vital for everyone in the Town to work together to make the new system a success. To ensure the best opportunity for recycling, all waste needs to be separated into the three bins provided:
Avoid contamination – Use the Correct Bin
It is imperative that once the FOGO bin is delivered, that Glass, Plastic, Metal or any other non-compostable items are NOT placed into the FOGO bin.
Clean recyclables before placing into your Recycling bin.

What support will I receive to help me with the new bin system?
The Town of Bassendean is passionate about managing our waste more sustainably, and empowering the community to be able to do the same.
Everyone has an obligation to recycle more and produce less. The Town will undertake a thorough engagement process with the community to ensure residents are clear about how this can be achieved, and support will be provided to guide everyone in using the new system.
What will the Waste Local Law cover?
The Town of Bassendean’s Waste Local Law is based on a Western Australian Local Government Association model Waste Local Law. The laws will address all aspects of the Towns waste management services with provisions relating to the planned three bin service, verge collection, public bins and waste management facilities.
Are other Local Governments also making similar Waste Local Laws?
Yes. The Director General of the Department of Water and Environmental Regulation has now provided consent to waste local laws submitted by 12 other local governments with many others having commenced the process to seek consent.
Will I be fined for doing the wrong thing?
The new local laws include the ability to issue infringement notices where offences have been committed. Financial penalties for failing to comply with the laws will be used as a last option.
As part of the roll out of the Better Bins / 3 Bin Program, the Town will provide educational information to encourage people to change their waste separation behaviour with the aim to increase recycling, prevent contamination of the FOGO bin and better manage the waste streams. If an individual’s behaviour continues to be in contradiction of the local laws then a fine may be issued.
